المخالفات الانضباطية لرجل قوى الامن الداخلي(*)

الملخص

تعد المخالفة الأنضباطية أحدى المرتكزات الأساسية للنظام الأنضباطي، فأن أي فعل مخالف يصدر من رجل قوى الأمن الداخلي مخالف للأنظمة والقوانين تفرض عليه العقوبة الأنضباطية من الأدارة هذا من جانب ومن جانب آخر فأن النظام الأنضباطي يعني بتوفير الضمانات الأساسية لرجل قوى الأمن الداخلي طالما أن هذه الدراسة تختص بالمخالفات الأنضباطية لرجل قوى الأمن الداخلي حيث لم تشر أغلب التشريعات إلى تعريف المخالفة الأنضباطية ومنها التشريع العراقي في قانون أصول المحاكمات الجزائية لقوى الأمن الداخلي رقم 17 لسنة 2008م وكذلك التشريعات المقارنة  كالتشريع المصري وفقا قانون هيئة الشرطة المصرية رقم 109 لسنة 1971م المعدل وكذلك التشريع الأردني بقانون الأمن العام للمملكة الأردنية الهاشمية رقم 38 لسنة 1965م المعدل ، إلا إن الفقه أشار إلى عدة تعاريف للمخالفة الانضباطية أشارت لها هذه الدراسة ،فضلا عن  القرارات القضائية ألتي صدرت من محكمة قضاء الموظفين في العراق والمحكمة الأدارية العليا المصرية في مصر وكذلك محكمة العدل العليا الأردنية في الأردن وكذلك سلطنا الضوء على أهم صور المخالفات الأنضباطية ألتي تم تقسيمها ،إلى مخالفات إيجابية وسلبية ومخالفات بسيطة ومركبة واعتياد ، ومخالفات وقتية ومستمرة.

Disciplinary violation is one of the basic principles of the disciplinary system. Any act of violation committed by a member of the Internal Security Forces is contrary to the laws and regulations imposed on him by disciplinary action. On the other hand, the disciplinary system means providing the basic guarantees of the ISF. Disciplinary breaches of the Internal Security Forces, where he does not mention most of the legislations define the disciplinary offense, including the Iraqi legislation in the Criminal Procedure Law of the Internal Security Forces No. 17of 2008, as well as the comparative legislations such as the Egyptian legislation according to the Egyptian Police Law No. 109  of 1971   as amended and Jordanian legislation in the Public Security Law of the Hashemite Kingdom of Jordan No. 38 of 1965. However, the jurisprudence referred to several definitions of the disciplinary offense in this study, as well as the judicial decisions issued by the Court of Staff Judiciary in Iraq and the Supreme Administrative Court of Egypt in Egypt as well as the Jordanian High Court of Justice in Jordan. It will also shed light on the most important images of disciplinary violations that have been divided, to the violations of positive and negative and minor violations and complex and habitual, and violations of temporary and continuous, and in terms of subdivisions were divided into irregularities in terms of substance and violations in terms of gravity.
