Abstract

The modern state was characterized by setting legal rules that guarantee the public freedoms of individuals, determining the authorities' exercise of their functions, setting general frameworks for the rule of law, and the supremacy of the principle of legality, which means submission to the law, and that this principle turns on all, whether they are rulers or ruled, chiefs or subordinates. Under this theory (exceptional circumstances) it is permissible for the state or one of its authorities, which is often the executive authority, to deviate from the provisions of the constitution or laws if it is necessary for the public safety of society, and that exceptional circumstances express an unusual occurrence, such as being a threat to society, or the system The general nature of the country, or threatens a segment of it, or part of it. The nature of these circumstances varies, and they may be caused by wars, natural disasters, or the spread of epidemics.Perhaps epidemics are more dangerous than other dangers, such as wars and natural disasters, and the best witness to this is the Corona epidemic or Covid 19. restriction of rights and freedoms
