Diwaniyah orders in Iraq are administrative decisions issued by the Council of Ministers in its capacity as a competent authority to issue organizational administrative decisions, as well as some individual decisions. The amended internal law of the Council of Ministers No. (2) of 2019 without explicit regulation of this issue Especially since the Council of Ministers in Iraq used to issue Diwaniyah orders and this name was used for this type of administrative decisions, and it issued many of them, whether they were individual or organizational, and in light of the multiplicity of bodies issuing Diwaniyah orders, the challenge to these Diwaniyah orders before the judiciary encountered a problem, some of them turned to The appeal was before the Federal Supreme Court, which in turn denied its jurisdiction over those orders, while the Administrative Court is competent to monitor administrative decisions, including diwaniyah orders, which is what actually happened in application of the relevant legal rules, so the Administrative Court exercised this oversight.
