Abstract

It seems that respecting the rules of international humanitarian law will avoid the occurrence of many cases of forced displacement. Moreover, this law contains two types of provisions that serve as a basis for establishing international protection for forcibly displaced persons, on the one hand as the law that aims mainly to protect people in times of conflict International and non-international armed conflict, it provides protection for people displaced by armed conflicts, not in their capacity, but as ordinary civilians. On the other hand, this law contains explicit provisions prohibiting internal forced displacement. It is noticeable here that international efforts have crystallized in the form of bilateral or international agreements to address the issue of forced displacement in accordance with the rules of international humanitarian law. This protection developed until it emerged in its own independent laws, and the most prominent development was in the conclusion of the four Geneva Conventions of 1949 and the two Additional Protocols of 1977, known as international humanitarian law, which established a set of protection mechanisms to prevent any violations, especially for civilians, and not direct military attacks against them or targets. As long as they do not participate in direct fighting and direct only against military targets, indiscriminate attacks are prohibited, all acts of coercion, torture and collective punishment are prohibited, and all retaliation, hostage-taking and the forcible transfer of the population are prohibited. Within the borders of their country, including the protection of physical and moral integrity and the principle of non-discrimination.
