The accused has the right to appoint a lawyer to defend him before the criminal courts. The interest of the international community as a whole, and this was evident in international documents, declarations of human rights, public and private agreements and international conferences. Arab countries have guaranteed this right in their constitutions and procedural or penal codes. To provide protection for the accused to defend himself and considered the right of defense sacred and in all stages of the criminal case, with the clear discrepancy in the procedures of criminal courts regarding the right of the accused to defend himself through a lawyer chosen by him or assigned by the court in the event that he is unable to appoint him. The recognition of this right by the Arab countries in their constitutions and fundamental procedural laws has become obligatory for the criminal judiciary to enable the accused to have this right. This invalidity has implications for the criminal case.
