The research examines the alignment of criminal evidence rules between Iraqi legislation and the International Criminal Court by comparing the rules of criminal evidence in Iraqi law with those established by the International Criminal Court, while highlighting the constraints imposed by international judicial conviction. The focus is on how principles like the presumption of innocence and the burden of proof are applied within both local and international frameworks, as well as the impact of the principle of doubt in safeguarding the rights of the accused. The study aims to propose practical solutions to enhance the integration of national legislation with international standards, ensuring a balance between Iraqi legal sovereignty and the requirements of international justice.
