Abstract

The margin purchase contract occupies great importance in the national economy of different countries of the world, and since the margin purchase contract gives way to low-income owners to invest their savings in the purchase of securities and because these savings are not sufficient for this purchase, as these investors resort to the margin purchase contract, which is that the financial intermediary company By paying part of the value of the shares purchased in exchange for mortgaging the investor these securities with the financial intermediation company, so that the investor pays the remainder of the price when it is due. There is contentment, location and reason and given the importance of this issue, most of the legislations in different countries of the world have adopted it, until the Iraqi legislature did not adopt it, and therefore we chose to discuss the formation of the margin purchase contract from a legal point of view.
