The legal system for establishing private higher education between constitutional and legal - an analytical and evaluation study

The establishment of private higher education institutions in Iraq is subject to a distinguished system of law, due to its connection with the various other branches of law, especially after the constitution stipulated private education. The law that organized this type of education was in fact developed to meet the requirements of the stage following the issuance of the law, and to solve some problems of establishing educational institutions The special high prior to the enforcement of the law, which requires that these remedies have constitutional foundations, just as the legal organization must achieve reasonableness and be sensitive to the facts of reality and not be inconsistent with other laws in addition to the need for its formulation to be sound in terms of language and logic. This is what we have noticed in some texts related to the establishment of private higher education institutions.
