Abstract

The research shows the constitutional terms of reference mentioned in the core of the constitution document and related to the Federal Supreme Court in the text of Article (93) of the Iraqi Constitution for the year 2005 in force, and these terms of reference were mentioned exclusively, so the Federal Court cannot bypass the constitutional text. To institute it, as well as clarifying the terms of reference of the higher courts in comparative law and the procedures followed to institute a constitutional case in both the United States of America and the United Arab Emirates.
